What is the specific law which states that marijuana is illegal and where can I find it online?
In a debate over states’ rights, the opposer adamantly states that the legality of marijuana is a state issue, and not a federal one. I know this to be false because if it was a state issue, there would be no DEA, californians would not be arrested by federal authorities for its medical use, as well as common sense. However, I can not back this up without the exact clause which states this.
The Controlled Substances Act of 1970 classifies marijuana as a Schedule I drug. Under the Supremacy Clause of the Constitution, Federal law in the United States preempts conflicting state and local laws.
Personally, I think it should be an issue for the States, and the Federal government should stay out of it. But try to convince the people who make the laws.
