What if California legalizes marijuana and I live in another state?
So California will vote on weather or not to legalize marijuana for recreational use. Assuming it passes, if I live in another state, is it legal to go to California and smoke weed there? Will I still get in trouble for failing a drug test in my home state even if I smoked it in California where it is legal?

Drug tests are given as a condition of parole or in order to work at a business. This is no different from a business requiring you to not drink on the job or having to abstain from alcohol as a condition of parole.

Even if you live in California and it’s legalized, employers will still have the right to say you can be fired or not hire you if you fail a drug screen.
I guess it would be like in Holland. You can smoke all you want, watch all the porn you want but if you’re an MP and forget a gay porn in your suitcase, your political has taken a downturn.
Think about.
A drug test tests whether the person used a drug; it doesn’t test whether or not it was taken legally in another state.
I suspect that if California passes such a law, that the Feds will pass another law to supersede it. That happened in Georgia when the state passed a GOOD law against payday lenders only to have Washington overrule it because of PAC money. Hmmm. I wonder where they got the money?
Marijuana is still illegal at the Federal level, so you could have some trouble there.
Won’t help you on the drug test either. You are doing a drug test as part of an agreement you made with some other party. You got benefit from the agreement… you got a lousy blue collar job, or you got out of jail. Doesn’t really matter what the law is, it matters what the agreement is. If you agreed to be clean, then you can’t go “Oh hey, they made it legal”.
Put it this way, if the drug test included alcohol, would you need to not drink?
P.S. Evidence of marijuana stays in your system for a very long time – months. Unlike almost all other drugs which purge out after a day or three. With pot particularly, the test will pop on tokes from months ago that have no effect on your functioning today.
