I think the driver plus the passenger are both respnsible, unless the passenger says the driver was unaware.
If you are asking what will happen if a jury ultimately believes the claim of the driver that he was not aware of the marijuana, the answer is that he would be acquitted. Somehow I doubt if that is what you are asking. I suspect you are asking if all cops are required to believe the claim of ignorance. They are not.
