What are the charges for a minor caught in possession of marijuana and prescription drugs?
My friend, who’s 17, was just arrested last night for possession of marijuana. Then they found out he had prescription drugs in his pocket so he was forced to spend the night in jail. He has to appear in court today, but I was just wondering what kind of punishment he could get. I’m so worried.
Also, we’re from Wisconsin.
While the legal gap decreases with every state victory, there remains a prevalent misconception that marijuana is a... Read More »

2 charges of possession of a controlled substance in Wisconsin:

The punishment the court gives him is the least of his problems. If he gets tried as an adult he will have a criminal record which will bar him from getting certain licenses, jobs, government assistance, scholarships, entry into schools…. and he will be at the bottom of the barrel for just about any job he ever applies for.
Good news is that he’s a minor. I’m not familiar with your state laws, but I see no possible way he’d get jail time, punishment could range from just a fine, to probation (no big deal, he just better quit drugs and stay out of trouble, to probation with a suspended (small) jail sentence. If he can’t comply with his probation, he has a serious drug problem, cuz if you party “normally”, you can quit. If you can’t quit drugs/booze while on probation, that means you have a substance abuse problem.
I wouldn’t worry about the marijuana charge. Prescription drugs are regulated very heavily. If you have a narcotic outside of a prescription that’s pretty much a felony. 9x’s out of 10 (at least in my state, NC) if you get multiple charges they drop possession of marijuana. I’ve been to court a lot over it. You don’t usually see prescription drugs get dismissed. I still got charged 100% as a regular adult for the misdemeanors I committed (at 16). All 1st offense got me was a PJC (prayer for judgment clause) which was like probation/temporary expunge. If you get in trouble again though it’s like having two charges hit your record at once. I’m not really into all that stuff now but they always kept the paraphernalia charge over the possession because it was more severe. Possession of marijuana, unless you have like 2-3+ ounces, in most states is just a joke charge. They throw it out if you have others. Wisconson though haha… they are pretty strict on marijuana. If it is his second offense it’s a felony… plus the prescription (schedule 2 narcotic) drug felony. Yikes 😛
I hope you don’t have to do time. The problem with the American justice system is that the sentence for any amount of incarceration, for a white male, is anal rape.
