regarding schedule I drugs…?
I am a beginning pharmacy tech student, and I ran across some information that I find confusing at best. Marijuana is listed as a Schedule I (C-1) drug, and that, to the best of my knowledge, means there is no accepted safe level of use, even under medical supervision. I am in Oregon, and here we have the Medical Marijuana act, which allows people with certain disabilities to grow and use, and carry Marijuana legally. I have also been told that in certain circumstances, Heroin (under its pharmaceutical name, which I can’t recall) is also used, though rarely. How can these drugs be used, if the FDA is labeling them C-1 drugs? Any information that might be helpful is appreciated.
It’s a state vs federal issue. In 2005, the Supreme Court ruled that medical marijuana is not legal. They cited, get this, the (interstate) commerce clause as the basis of Congress’ power to regulate what medical marijuana users privately grow. State decriminalization is fine, but federal laws still apply. The feds occasionally raid dispensaries in California. It’s my understanding that prescribing medical marijuana is illegal due to scheduling, but that approving patients for medical marijuana is legal (like selective decriminalization). For what it’s worth, simple possession is rarely prosecuted by the feds.
Hope that clears it up a bit.
C-1 drugs and some C-2 drugs are mostly your illegal drugs. With C-1 drugs, you can get permission to experiment with them, but it takes a lot of paper work and time to get the permission. The federal government had a trial involving marijuana in the 1980s, and even though they stopped the trial, they still send monthly shipments of it to the few remaining survivors. The government actually does grow amounts of the C-1 plant drugs for their own and others research. Marijuana is an illegal drug everywhere in the U.S. Why does no real pharmacy carry it because carrying it will result in the removal of their controlled substance license. The law states, when there is conflicts regarding scheduling of controlled substances between the state and federal laws, the stricter law allows applies. People carrying “medical” marijuana can be arrested at any time.
