I wonder how it would turn out if they raided Pharmaceutical Drug manufacturing? Or they went after sample dispensing reps, who often share drug samples with people in their family and friend circle…they don’t need to do this stuff….
However certain amendments later created limits this Federal power. Since then precedent has been set numerous times by the Sup Ct that limits the extent of the supremacy clause with respect to state issues. I am pro medicinal marijuana, but the legislation is still very sloppy with tons of loop-holes, so we see these types of marbling issues.
@NOBEANERS No true bro, actually most fed law trumps state law. Matter a fact, it’s a main focus in Const’al Law classes. The clause known as the “supremacy clause” is clearly outlined in Article VI of the US Constitution:
“The Laws of the United States…shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the constitution or laws of any state to the contrary notwithstanding.”
funny how they for got to mention that the couples houses that were raided had two patients living there and one was a caregiver! so they were allowed to have a total up to 24 plants
If undercover cops are buying marijuana from this “dispensary” then the place should be shut down. If every plant is accounted for and all the processed medicine is distributed to their patients only….this would most likely not happen. The state statutes say exactly how to grow and distribute to patients. It is places like this that can make it tougher on us other growers.
