Is it true that the police can seize your car if they find marijuana in it?
I’ve heard that if the police pull you over and find marijuana they can seize it. Obviously if you have bricks of weed in your car they will seize it, but if its a small amount…like less than an ounce can they still take it?

It probably varies from state to state, but in Michigan, yes they can. It is doubtful that they will sieze it for a small amount, but they can.

If you have enough marijuana to indicate possession with intent to distribute, or if you are under the influence of marijuana, yes they can impound your vehicle.
But that is CA law, not sure what the laws are in your state.
Also, if you have enough to warrant possession with intent to distribute, you may lose your vehicle permanently under the asset forfeiture law.
the theory behind posting that question-tell everyone that they can seize your car. it will deter drug traffickers.

This law varies from state to state, but the premise of the law is that if you are caught with an amount that can be considered for distribution, they can take your car, home, or any other assets that are deemed to be gains from ill means. This money or the value of the property (after sold at auction) is then divided between state and local law enforcement to cover the costs of drug enforcement efforts. So the basic answer is yes the police can take your car, home, and cash. The county of San Diego was able to get 2 helicopters by use of this law. Now the Helicopters are used for law enforcement by the San Diego county sheriff’s office.

That Depends. I will explain how it is where I work, but I imagine it is simmilar where you live.
1. Did you admit to being under the influence of the marijuana? If so even within the past few days, you can have a DUI metabolite which is the same as a DUI.
2. If it was over an ounce, it becomes a Felony where I work, and yest, you will get your car taken.
3. Most of the time, if I find someone with a small amount of marijuana I just write them a citation for it and book the marijuana in evidence for the case. That is unless one of the above mentioned things or some other contributing circumstance. You can lose your license If the officer wants to, but I don’t push it on the person that hard.
No, I don’t believe it is true:I know of a drug dealer in California that was caught twice within a few months for selling drugs out of her house and cars, which she owns! They gave her 2 years in prison (5 concurrent terms of two years each, in reality this means only 2 years!!) She still has her three cars and expensive home!! I think that this is a scare tactic that has failed.
However, this women I’m referring to is white and middle class. An African american or hispanic might be a different case though.

Yes and you will have to pay to get it out of impound. Depending on where you are in the world I think it is like $50 a day. Good Luck
