I ask this because honestly how many people buy a hookah to smoke tobacco in? I am just utterly flabbergasted by the way our government works. No body buys a grinder to grind there tobacco in especially when it has a pot leaf on it. Please respond I need some feedback from this.

Because people that smoke will ALWAYS be able to find it and selling the things to smoke WITH is not illegal. I don’t understand why people want to kill themselves…the chance of getting lung cancer if you are a pot smoker is more than if you are a cigarrette smoker, as pot has more tar in it. My dad died after lung cancer. He smoked cigarettes for many yrs. He quit 12 yrs before his diagnosis. The DR said had he (not started ..DUH) quit 5 yrs before, he may not have lung cancer at all. The earlier you quit, the better..of course, never starting is the key…cigarettes OR pot.
you answered it yourself, its for “tobacco” thats how they get away with it. But honestly, quite a few people do use that stuff for tobacco…not as many as use it for pot of course, but thats how they do it. Unfortunatly what you are overlooking is the fact our government doesnt really care. With all the anti drug campaigning money they have spent over the years, the government could have bought, and destroyed every major drug cartel in the world three times over. they make a fortune on this stuff, they wont quit
Because there is a market for said products. A huge market actually. There are loopholes in everything. So long as the “product” is presented as a way for smoking tobacco, it’s totally legal. Besides hookah bars are spreading like wildfire. Smoking flavored tobaccos is a big in thing.
Believe it or not, I went to a store that sells that stuff to get replacement screens for my kitchen faucet.
I have no idea why they can sell stuff that is designed to be used with illegal drugs. Some of the stores have a notice up saying that these items are not intended for use with illegal substances. Maybe they’re selling them as knick-knacks.

I don’t about about in America, but in Canada you can legally buy and possess marijuana seeds, as long as you don’t plant them.

#1 Hookas are tradtionally used to smoke a sweetened tabacoo called shisha. Sometimes marijauna can be mixed in, but it does have a legal purpose. A hookah is only parafanalia if you misuse it. To deem a hooka as just a piece of paraphanelia is kind of culturally insensitive on your part. Hookahs are often intracate peices of art which have been passed down in families.
#2 Pot is not always illegel. A number of states have medicinal marijuana laws. If an AIDS patient needs it so they can eat, or if a cancer patient has to smoke to quell the pains of chemo, they need something to smoke it out of. And it is legal for them to do it.
#3 A grinder is used for spices and herbs not tabacco. Again it is a legal product with non pot related uses.
#4 Even bongs- which should be refered to as “water pipes” filter out many of the carinogens in tabacoo smoke.
#5 Even if you out lawed every peice of “paraphanelia” people will still smoke just as much pot, they will just smoke it out of something else. No stoner has ever sat around with a bag of weed and no pipe with out figuring out another means of smoking it. Every stoner in has smoked out of a pop can at least once. So going after the pipes will have no impact at all.
So to sum it up, baning these things would be a waste of time and resources and would victimize people who are not breaking any laws as well as those who want to smoke pot.
While marijuana is illegal, there are arguable legitimate uses for much of marijuana paraphernalia – even if most people don’t actually use them that way, so it is unconstitutional to ban them entirely. Essentially the law is designed to make it illegal to sell or possess something that is primarily intended to facilitate taking or making a controlled substance. Without direct evidence to the contrary, if a head shop says that the products are for use with tobacco only, there’s not much that can be done. Possessing drug paraphernalia (meaning paraphernalia that has actually been used to consume illegal drugs, which can be determined by lab tests) IS illegal.
It’s because cannabis isn’t the only herb people smoke. There are a number of legal herbs you can smoke and get a mild buzz from. They have been around for thousands of years.
In my area smoke shops can sell paraphernalia as long as they sell some legal burning herbs. If you look you’ll see shops that sell hookahs also sell the special honey soaked tobacco and charcoal you use in them

I remember my oldest sister grinding teas in those grinders. She ground all sorts of teas and herbs in those….
It doesn’t matter what the person is doing with the item once it is out the doors. They are sold as tobacco products, period. This is legal.
You have never been around people who use teas and herbs, right? Never been around people who would rather live there lives this way?
