If the feds want to prosecute Californians they still can. President Obama recently said that he will not have federal raids in states that decide to legalize it on a state level, whether or not he sticks to that is yet to be seen.

Here in MA it’s a misdemeanor. $100 fine and that’s it unless you’re caught with amounts large enough to distribute.

Anyone can get away with smoking pot, I think its legality situation is mainly to keep the people that shouldn’t be using it, away from it. A lot of older people still smoke pot in their own home, and there has been no repercussions.
In Toronto, they decided it wasnt worth filling up the prisons and charging the tax payers for such a harmless substance. A person is allowed to have approx 3 grams.
California marijuana can be bought with a prescription and there are some doctors who will take the money to write out prescriptions for medicinal marijuana for people who don’t need it for medicinal reasons. The only legal way to possess and use marijuana in California is if you have a prescription given by a doctor who is licensed by the state.
This isn’t isolated to cali, a total of 14 states have legalized marijuana for medical use. The reason so many avoid prosecution is because the state authorities no longer enforce anti marijuana law, and there are to many people using it over too wide a geographic area for federal agents to even have a hope of prosecuting even half of the users. Some people have also gotten around anti marijuana law by joining cannabist churches and gaining 1st amendment protection, aswell as various other court precedent protections.
Wow… Im pretty sure its still illegal in Cali, but thats the least of the states problems. When you have meth, cocaine, herione, and other hardcore drugs flooding your streets. Weed is not as important anymore, besides the jails are too packed. They can’t put people away for such little things like smoking pot when they are trying to make room for killers and thief’s in there jail.

There was a Dateline special on this only a couple of weeks ago. It is still a federal crime for the people selling Marijuana to sell it, but the State of California legalized the use and distribution of Medical Marijuana, so essentially, the people selling it and buying it risk federal prosecution.
Maybe those people who made that rule were on it while they were making it?

Marijuana has not been legalized in California. It is de criminalized for first time possession of a small amount. If caught it’s like getting a traffic ticket. But if you are caught with 28.5 grams the penalties are quite severe and could land you six months in jail.
The state and local governments refuse to cooperate with the DEA. So the DEA is on their own and without the help of the locals; they are severly hamstrung in their efforts.
MARIJUANA IS NOT LEGAL IN CALIFORNIA. Yet, but perhaps soon as a way of trying to generate more tax income to pay for the civil service bloodsuckers who are destroying the quality of life of all those who have to support their parasitic do-nothing useless….well fill in the blank with your favorite adjectives.

IT’S NOT LEGAL – All of the drugs you mentioned are used in one form or another in the medical field (cut if you will- a base with other things mixed in).
Doctors can prescribe marijuana/drugs across the county not just in Cali . You just can’t go to the store and buy it outright.

Wow, a lot of silly answers to this. Here’s the deal. Back in 1997, California voters passed proposition 215 which stated that with a doctor’s RECOMMENDATION (NOT prescription), a patient could not be prosecuted for possessing OR growing cannabis for the condition indicated.
More recently, CA senate bill 420 (I’m not making that up) set clear guidelines that all counties in CA must follow…stuff like setting a limit on how much each county could constrain a person with a recommendation from growing (I believe it is up to four plants).
The way this has worked out is that anyone in CA with $150 can go to a “pot-doc” and get a recommendation. If you are caught by the police with marijuana on you, if you show them a copy of your recommendation, they will hand back the pot and let you go (in Northern California at least…Southern California has not been as accepting of the new laws). In fact, in the city of Oakland, measure Z passed back in 2004 which made marijuana the lowest law enforcement priority such that pot is nearly as legal in Oakland as Amsterdam (there is now an downtown region named “Oaksterdam.”). In other words, marijuana is “de facto” legal in CA because just about anyone can buy the right to possess it from a doctor.
As for the Feds, some of the other posters are correct in saying the Obama DEA and Justice department have said they will not pursue cases against medical marijuana stores that are operating legally under CA law. However, I’m sure that if someone here walked past a federal agent while smoking a joint, said agent would be legally bound to make an arrest. What’s perhaps more interesting is why for 8 years under the Bush administration the entire thing was not simply shut down. California grows billions of dollars worth of pot each year, with thousands of “dispensaries” (stores that sell to folks with recommendations”, and in theory, they (the feds) could have rolled all of them up at any time, but they didn’t. That’s an open question for sure, but the fact that all those pot dispensaries DO pay federal sales tax on every transaction might have something to do with it.
Anyway, that’s the deal. Pot is still schedule I under the DEA’s system and technically is still illegal in CA, but much like Amsterdam, it’s essentially legal in practice.

They are being federally prosecuted when the evil Nazi’s in our government decide to infringe on the state’s policy. Marijuana prohibition is a joke overall. More prison space, tax dollars, etc are wasted on prosecuting non violent “criminals” over marijuana related offenses than would seem reasonable at all. You’d expect after seeing such a high percentage of the country likes it, that it would be legal but whatever.
The answer to your question is, individual states can deprioritize or do away with the enforcement of certain laws. However, if there is a federal law which mandates it be enforced, the feds can still enter the state in question and perform raids and arrests.
Why in god’s name good sweet Mary Jane is placed on the same level as drugs which fry your brain (LSD), or through repeated use cause brain fog (Psilocybin), or cause extreme addition and destroy the body (heroine, meth, cocain, crack etc), I will never know… except THAT, more people use marijuana, so in order to justify budgets, money must be NEEDED, which means the more arrests made, the more money the department in question most likely receives.
Technically even though I hear california is somewhat lax on prosecuting potheads, it still goes after dealers and people who cultivate it, it’s only technically legal in california currently to medical patients who have a license to use it. It amuses me that the pharmaceutical industry tried to create a drug which follows their normal practice of “sicken to cure”, called marinol, which from what I understand does not work, and also further sickens it’s user.
In general the fact that MJ is illegal sickens me, it has so much benefit, for recreational, psychological, and medical use. Why charge us $175+ for a presciption pain killer that leads to addiction and side effects, when we can just roll a joint and smoke it, is the real question.
The real problem these days is NOT weed, all the pill companies are producing drugs which see far more ‘abuse’ and lead to more people frying their internal organs and messing up their brains, than a benign plant that makes you happy, then makes you hungry, and then after, makes you want to take a nap… and causes no harmful side effects if imbibed properly and not overused.
