How can MI allow medical marijuana even though it is still illegal under federal law?
For instance, if a caregiver is allowed under Michigan law to grow a limited amount of marijuana for someone (patient) who is allowed to possess and use it, is there anything keeping the feds from busting the caregiver? if not, what is the point? is someone less likely to get prosecuted by the federal government if the crime is legal in the state? i’m confused.
There is nothing to prevent the feds from making a bust – except common sense. Under the previous administration, such busts and prosecutions were common. Under the present administration, the situation promises to be different – the feds will defer to the will of the individual state.
Because the federal government isn’t going to push the issue too hard. It is illegal, no doubt about it, and a person can be arrested by federal law enforcement for some violations, but just because it’s a law does not mean it will be enforced.
The same way states like California does it. I think the federal government has more important issues on their agenda than going after marijuana users.
Remember at one time our esteemed federal government tried to outlaw alcoholic beverages because they thought the abuse of alcohol was responsible for so much damage to society. Hopefully they’re starting to see the light, our current anti marijuana laws aren’t much different that what prohibition was back in the 1920’s.
Aren’t we all.
California has the exact same problem, you have to ask yourself?
What’s more important, a persons right to helpful, natural, symptom relieving drug or the governments law to extract money from it’s citizens by force and seizure.
Earlier this year, legal medical marijuana dispensaries were being busted by the DEA because even though they were being legally run, they were still illegal under federal law. Obama’s supposedly trying to make it so the federal government now has to respect state laws so this doesn’t happen anymore. The best way to try and prevent this is to not tell anyone about the crop, so no one gets tipped off that it’s there. No one needs to know in the first place, and after harvest, the patient still gets their medicine.
Its still illegal under Federal law. So the caregiver gets busted. Period.
This has been battled and bashed out in California now and the state of California lost several times.
The supremacy clause of the Constitution trumps state laws.
