I don’t mean to burst your bubble, but the law was not written to give anyone a free pass on drug abuse. Yes, it still applies to second time offenders and they will still be arrested.

No one will be arrested for possession of less than an ounce of cannabis in Massachusetts, regardless of prior offenses. Possession will be a civil offense, like a traffic ticket, and the maximum penalty will be a $100 fine. There can be no other penalties imposed. (See the cite below for the full text of the new law.)
The act is set to take effect on December 5, unless the legislature amends it. According to the chief of staff of the speaker of the house, there are no plans to amend it. (See cite to WBZ report below.)
