I do not believe so, but forfeiture laws are loosely written and I have never heard of a ruling made in favor of a defendant. How much are you willing to spend to recover property that has had some cop’s dog slobbering all over it? They may not be able to seize it, but they can fix it so it is no longer worth your time and money.
YEP, if you were locked up for DUI or minor drug crimes, they can seize the vehicle if noone can pick it up, or if they believe your vehicle holds evidence of something much BIGGER.
Usually that’s what they can do it……..they got you on a simple misdemeanor, however they Actually got something else on you or have enough underlying evidence to suspect something bigger……
Even refusing a search in most states can open you up to an Instant vehicle seizure or impound.
