You have to have a caretaker card to grow legally. He should be able to get a card for you to grow for him.
I think it is most reasonable to “help him” grow it. Make sure it is on his property and be a friend and come over daily to tend to the sweet, sweet, delicious plant that I am sure there will be plenty for you take for your hard work and efforts being a good friend.
However, I do not think you will get legal approval to grow for him. That is not how it works.
Medical marijuana in Oregon rocks! You are very lucky!
Hmmm. Lets all put our thinking caps on and work really hard on this one….
I’m not familiar with the laws in Oregon specifically, but I can tell you about the laws in California, and that’ll give you an idea of what to look for.
Not all the states that have legalized medical marijuana laws have caregiver laws. Caregivers are those who can grow, hold, transport marijuana for their patient. In CA the laws are that technically all you have to do is have a paper saying I…..designate………as my primary caregiver, and both sign and date. But to be the most protected legally you should get your friends doctor to add it to his recommendation.
Primary Caregiver is defined as someone who cares for their patient in a manner beyond distribution of marijuana. You obviously have a real relationship with this man so this won’t be a problem to prove.
If caregiver laws are legal in Oregon then yes, you can grow for additional patients as well, however you must have signed caregiver forms for each patient.
Learn the laws learn to be responsible. Refer to marijuana as medical marijuana or medication, do NOT refer to it as “pot” or “weed”. Always transport mmj in your trunk as a warrant is needed to search the trunk of a car. ALWAYS keep your recommendation on you.
The specific laws as to how much marijuana and plants you can have varies from state to state go get that information and never be above the legal limits.
And NEVER EVER grow more than 100 plants (this includes baby ones, “clones”) as it is a Federal matter and is a minimum sentence of 5-25 years depending on the state.
Remember marijuana is still illegal 100% federally. Do not assume that state protection extends to the federal government, or matters at all. If you are brought to trial in federal courts you WILL NOT be allowed to use medical marijuana as an excuse.
Good luck, and welcome to the cause.
