Drug charges? I had a complaint at my apt.about noise. The cops came, smelled pot, and searched inside. They..
found about 10 grams of high quality pot and two paraphenelia items. They seized everything of course. Luckily, I havent been charged yet. But the officer said I have to call him in the next 5 days and give him any leads to possible growers. I dont know any! I dont even know the sellers. If I cannot provide him w/ insight into where the growing is taking place, I will be probably faced with some misdemeanor charges. What would they be? i know i’ll go to court with some fines. Will they take my driver’s license away? There is NO WAY that I am going to snitch and get my ass blasted by someone crazy. So I want to man up to the charges so no one else gets in trouble… PLEASE…Someone give me some advice on how to explain myself to the officer when I have to call him in 4 days, & anyone with any expertise in this sitaution, please reassure me everthing will be OK..
wait for them to file charges, then when you go to court tell the judge they searched your home without a warrant. Or get a lawyer and file charges against the city because they searched your home without the warrant, along with the extortion they are attempting by not filing charges if you give them leads to a grower.
Well it all depends on where you live? But Less then 1/2 and ounce of pot is usually not much of an offense in many places. Don’t tell them anything. You will most likely just be fined , if you can afford a lawyer get one
smart man. you’ll be fine, they thought you were a punk but they were wrong. You’ll have to pay some fines up to like $300 and maybe piss test for a few months. Thats at most.
STOP SNITCHIN!!!!!
you don’t have to drop the dime on anyone. when they ask you where you got it just don’t cooperate. if you feel you have to say something then lie. tell them you were driving around and bought it on some street corner. i just hope you don’t live in virginia or pennsylvania. they are much more likely to take your liscense away for drug charges. you’ll be fine.
Unless you gave them permission to search the apartment, which I’m assuming you didn’t, then the chances are that all the evidnce will get thrown out because they didnt have a search warrant. That is a viloation of your Fourth Amendment Rights (Unlawful Search and Siezure) If they have no evidence then you cant get punished. Get your self a lawyer in any case so that you are prepared for anything.
Did you let the police inside your house? If so and they just came across the drugs then this is perfectly lawful. More fool you! Were you arrested atthe time? If not then why not?
If you are more afraid of dealers than the police then simply ‘fess up to the crime of possession if charges are filed and refuse to reveal your dealers. They can’t make you.
I can’t reassure you that everything will be OK but this is not the crime of the century. 10 grammes is a small mount of pot and there appear to be no aggravating circumstances (no children around, no smoking in public etc)
All the best
It’s very, very unlikely that they can come back and arrest you five days after seizing the evidence.
Quality doesn’t mean anything to the legal system, so 10g of dirt or high grade is still 10g and only a small town is going to prosecute that quantity at all. The cop probably threw it away.
Keep your house clean and tell the cop you got it from some random guy at a park or something – personally, I wouldn’t even call him back.
Check this for your rights.
Hire a lawyer, cops play those mind games all the time. They weren’t allowed to search your house because they didn’t have a search warrant. Tell it to the judge in court.
First, if they said, “Can we come in?” and you let them and they found pot, that makes the evidence admissable in court.
Second, if they smelled it and went through training for a controlled burn to recognize the odor of marijuana, they can also search on the spot. It’s like leaving a dead body in the hallway where you can spot it from the door. If they see something to provide probably cause of a crime, they can pursue a search without warrent, if they can clearly and articulately describe the suspicion.
I say go, pay the fine, and be a little more restrained in your consumption of weed.
Seeing as the federal courts have decided marijuana smells like marijuana, and upon smelling marijuana, you are given probable cause to search a residence/vehicle…..
As far as them returning to you to arrest you for the pot and paraphernalia, In Missouri, the officer(s) would have an entire year to submit the paperwork to have charges filed against you.
He can’t blackmail you into giving him sources of weed; if any informant offers were out there, it would be the prosecutor offering them to you. He’s saying he’ll help you if you help him, but that’s a total lie. Get a lawyer.
